TERMS OF SERVICE

Effective Date: December 2025

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”) and 3Point Precision LLC, including its subsidiaries Headline Breaks LLC (DBA “Headline Breaks”) and The Locker Tampa LLC (DBA “The Locker by Headline”) (collectively, “Headline,” “we,” “us,” or “our”).
By accessing our website, purchasing goods, participating in live breaks, submitting items for consignment or grading, or using any Headline service, you acknowledge and agree to these Terms in full. If you do not agree, you must discontinue use immediately.

1. Eligibility & Acceptance of Terms

To use Headline services, you must be at least the age of majority in your state or province of residence and legally capable of entering into binding contracts.

By using our services, you represent and warrant that:

  • You have read and understand these Terms.
  • You agree to comply with them without exception.
  • You will not use our services for illegal or unauthorized purposes.

Headline reserves the right to refuse service, restrict access, or terminate accounts at any time for violation of these Terms or abusive behavior toward staff or customers.

2. Scope of Services

Headline offers a range of products and services, including:

  • Live break participation on third-party platforms
  • Sealed trading card products (“sealed wax”)
  • Raw and graded single cards
  • Authenticated memorabilia
  • Card supplies and accessories
  • Headline-branded apparel and merchandise
  • Headline-branded repack products
  • Consignment services for approved participants
  • Grading submission services
  • In-store retail sales at The Locker by Headline

All offerings are subject to availability and may change or be discontinued at any time without notice.

3. Accuracy of Information

Information presented on our website, mobile platforms, videos, or third-party channels is provided for general informational purposes only.

We do not guarantee that:

  • Product descriptions
  • Pricing
  • Inventory levels
  • Break schedules
  • Promotional materials

are accurate, complete, or current.

We reserve the right to correct any inaccuracies or update information at any time.

4. Payments, Billing & Fraud Prevention

Purchases are processed securely through Shopify Payments and approved third-party processors.

By completing a transaction, you agree:

  • To provide accurate and current billing information.
  • That all sales are final unless specifically stated otherwise.
  • Not to initiate fraudulent chargebacks or payment disputes.

Fraudulent disputes may result in:

  • Permanent removal from Headline services
  • Referral to collections
  • Recovery fees
  • Legal action

Headline reserves the right to refuse or cancel any transaction at its sole discretion.

5. All Sales Final Policy (Strict & Non-Negotiable)

The following items and services are strictly non-refundable and non-returnable:

  • Live break spots (including random, pick-your-team, draft, and hybrid formats)
  • Cards pulled during breaks
  • Sealed trading card products
  • Raw and graded singles
  • Authenticated memorabilia
  • Repack products
  • Grading submissions
  • Consignment submissions and fees
  • Any virtual, digital, or intangible services

Once a break begins or a product is purchased, no cancellations, refunds, or modifications will be issued under any circumstances.

Apparel may be exchanged within 14 days if unworn, unwashed, and in original condition with tags attached.

6. Live Break Rules (Legally Binding & Final)

6.1 Break Results Are Final

Break outcomes are determined exclusively by the live stream footage. Video review is the ultimate reference in any dispute.

6.2 Randomization

Random team assignments or draft order results are binding and cannot be appealed, modified, or reversed.

6.3 Manufacturer Responsibility

Headline is not responsible for:

  • Factory defects
  • Damaged or missing cards
  • Warped cards
  • Poor centering
  • Redemption fulfillment
  • Manufacturer errors of any kind

These issues must be addressed directly with the manufacturer.

6.4 Shipping Responsibility

Once a package is scanned by the carrier (USPS, UPS, FedEx), liability transfers to that carrier.
Headline is not responsible for loss, theft, delays, damage, or misdelivery caused by carriers.

6.5 Conduct Expectations

Harassment, threats, abuse, or disruptive conduct toward staff, breakers, or participants is prohibited and may result in immediate removal without refund.

7. Consignment Terms

7.1 Eligibility

Consignment services are not open to the general public. They are available only to:

  • Approved Headline Breaks customers
  • Approved beta testers

Headline may refuse or limit submissions at its discretion.

7.2 Value-Based Routing

Each item is evaluated and placed into one of the following categories:

  • Under $1 value (if approved): Donated to Wax For Good 501(c)(3). Tax documentation is available.
  • $1–$4.99 value: Sold through a Headline live auction starting at $1.
  • $5+ value: Listed across marketplace channels (Shopify, eBay, etc.) and may be displayed in-store.

Headline retains full discretion over market value assessments, listing strategy, and final sale channels.

7.3 Processing Time

Items are processed within four hours of the corresponding break’s completion unless otherwise communicated.

7.4 Fees & Commissions

Consignment fees vary based on service level, sale price, and platform.
Fee structures are provided directly to approved consignors and may change without notice.

7.5 Payouts

Payouts are issued twice monthly via ACH.
Headline is not liable for payout delays caused by:

  • Incorrect payment information
  • Banking delays
  • Marketplace hold periods

7.6 No Liability for Market Conditions

Consignment involves market volatility. Headline is not responsible for:

  • Pricing changes
  • Downward market movement
  • Buyer behavior
  • Auction outcomes

All consignment sales are final.

8. Grading Submission Terms

By submitting cards for grading, you agree:

  • All fees are final once the submission is sent.
  • Grades are assigned solely by CGC or third-party graders.
  • Turnaround times are estimates and not guaranteed.
  • Headline is not responsible for grading outcomes or delays.
  • Headline is not liable for damage occurring during transit, grading, or post-grading shipments.

9. Prohibited Conduct

You agree not to:

  • Harass or abuse staff or participants
  • Manipulate randomizations, auctions, or break results
  • Engage in fraudulent chargebacks
  • Tamper with platform security or site operations
  • Impersonate other customers
  • Interfere with Headline business operations

Headline reserves the right to pursue legal remedies for violations.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Headline is not liable for indirect, incidental, punitive, or consequential damages.
  • Our liability for any claim shall not exceed the amount paid by the customer for the transaction at issue.
  • You waive any right to join or initiate a class-action lawsuit against Headline.
  • All disputes shall be resolved via binding arbitration in the State of Florida.

This ensures Headline cannot be exposed to disproportionate damages.

11. Modifications to Terms

Headline may update or modify these Terms at any time.
Revisions will be posted on this page.
Continued use of our services constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
